These Terms & Conditions (“Terms”) govern your use of monica4council.com (the “Site”) and your participation in the text message program operated by Monica Martinez for Council (“we,” “us,” or the “campaign”). By using the Site or opting in to our text messages, you agree to these Terms.

- Opt-Out Instructions
- You can cancel the text message program at any time. Reply STOP to stop. After you send the message STOP to us, we will send you a message to confirm that you have been unsubscribed. After this, you will no longer receive text messages from us. If you want to join again, just sign up as you did the first time and we will start sending messages to you again.
How to opt in
We only send text messages to people who have given us express written consent. You can opt in by checking the unchecked SMS consent box on the sign-up form on our Site, or by otherwise providing your mobile number along with your agreement to receive text messages from us. Consent to receive text messages is not a condition of volunteering, donating, or any other participation in the campaign.
Carriers and delivery
Carriers are not liable for delayed or undelivered messages. Message delivery is subject to effective transmission by your wireless service provider and is outside our control.
Eligibility
You must be at least 18 years old, or have the permission of a parent or legal guardian, and be the account holder or have the account holder's permission for the mobile number you provide.
Your privacy
Information you provide through the text message program is handled as described in our Privacy Policy. We do not share mobile numbers or SMS consent with third parties for marketing or promotional purposes.
Use of this Site
You may use the Site for lawful, personal, non-commercial purposes. You agree not to interfere with the operation or security of the Site, attempt to gain unauthorized access to any part of it, or use it to transmit unlawful, harassing, or misleading content.
Contributions
Contributions made through the Site are processed by a third-party payment processor and are subject to Colorado and Denver campaign finance law, including applicable contribution limits and public disclosure requirements. Contributions are not tax deductible. By contributing, you confirm that the contribution is made from your own funds, on your own behalf, and is not from a prohibited source.
Intellectual property
The content on this Site, including text, photographs, graphics, and logos, is owned by or licensed to Monica Martinez for Council and may not be reproduced for commercial purposes without permission. You may share campaign content for the purpose of supporting the campaign.
Third-party links and services
The Site links to third-party services, including our sign-up form provider and our donation processor. We are not responsible for the content, terms, or privacy practices of those services, and your use of them is governed by their own terms.
Disclaimer and limitation of liability
The Site and its content are provided “as is,” without warranties of any kind. To the fullest extent permitted by law, Monica Martinez for Council is not liable for any indirect, incidental, or consequential damages arising from your use of the Site or the text message program.
Changes to these Terms
We may update these Terms from time to time. When we do, we will revise the “Last updated” date above. Your continued use of the Site or the text message program after a change takes effect means you accept the revised Terms.
